A judgment is a document that reports a court decision. An amicable divorce judgment (joint request for divorce on draft agreement) contains various information.
The divorce judgment mentions the Superior Court, the judicial district, the name of the Judge, the names of the parties. The judgment is rendered on the basis of the divorce application, the evidence provided and the documents entered in the file.
The Judge is based on the divorce agreement signed by the parties. This divorce agreement mentions the names of the spouses. A preamble clarifies the following elements:
- date and place of marriage
- place of first joint residence
- the matrimonial regime
- the date of separation
- the existence of an irreconcilable dispute
- the presence or absence of children
- etc.
The parties will then present what constitutes their family heritage such as the family residence, second homes, family vehicles, furniture, retirement plans.
They then detail their debts, personal effects, bank accounts, annual income, the matrimonial regime, alimony, tax, any claims between spouses, any obligations between spouses and the recognition of the parties to have understood the scope and content of their divorce agreement.
